PairOfDice Media Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PairOfDice Media’s website, creator platform, community, marketplace features, and related services (collectively, the “Services”).
By accessing or using PairOfDice, you agree to these Terms.
1. Eligibility
You must be legally capable of entering into these Terms to use features that require an account.
Users under the age of majority in their jurisdiction may require permission from a parent or legal guardian.
Certain features, including commerce, creator payouts, contracts, promotional services, or events, may have additional eligibility requirements.
2. User Accounts
You are responsible for maintaining accurate account information and protecting your login credentials.
You are responsible for activity conducted through your account unless prohibited by applicable law.
You may not impersonate another person, access another user’s account without authorization, create accounts for fraudulent purposes, or attempt to circumvent PairOfDice security systems.
PairOfDice may provide third-party authentication options such as Google or Facebook. Your use of those services is also subject to the applicable provider’s terms.
3. Creator Profiles
PairOfDice allows artists, producers, designers, writers, developers, photographers, videographers, podcasters, streamers, businesses, and other creators to establish or manage profiles.
Some creator profiles may initially be created from publicly available information for discovery or editorial purposes and later made available for an appropriate creator or representative to claim.
Claiming a profile does not grant ownership of PairOfDice’s platform, software, design, analytics systems, or other proprietary technology.
4. User Content
You may be able to publish profiles, posts, comments, polls, music, videos, images, links, events, products, services, portfolio materials, and other content (“User Content”).
You retain ownership of intellectual property rights you legitimately hold in your User Content.
By submitting User Content to PairOfDice, you grant PairOfDice a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, format, resize, transcode, promote, and otherwise use that content as reasonably necessary to operate, market, improve, and promote the Services and your presence on the platform.
This license ends when the content is removed to the extent technically and legally practicable, except for content already shared or incorporated into legitimate records, backups, promotional materials, or other permitted uses.
5. Rights to Uploaded Content
You may only upload or publish content that you own, control, are licensed to use, or otherwise have the legal right to make available.
You are responsible for obtaining any necessary permissions involving copyrights, trademarks, music compositions, sound recordings, samples, beats, photographs, videos, artwork, performances, likenesses, and other protected material.
PairOfDice does not acquire ownership of your music merely because you publish or stream it through the platform.
6. Copyright
PairOfDice respects intellectual property rights.
Copyright owners or authorized representatives may submit notices concerning allegedly infringing content through PairOfDice’s designated contact process.
We may remove or restrict access to content when we reasonably believe doing so is appropriate and may suspend or terminate repeat infringers.
Users who repeatedly upload content they do not have permission to use may lose access to PairOfDice.
7. Community Conduct
You may not use PairOfDice to engage in unlawful activity; threaten or harass others; distribute malware; conduct fraud or phishing; artificially manipulate engagement; spam users; attempt unauthorized access; interfere with platform operation; publish another person’s sensitive private information without authorization; or otherwise abuse the Services.
PairOfDice may moderate, restrict, remove, or reduce distribution of content that violates these Terms or applicable policies.
8. Music and Media
PairOfDice may allow creators to upload music or link to music and media hosted elsewhere.
Creators are responsible for ensuring they possess the rights necessary to distribute or publicly make available uploaded content.
Third-party media available through services such as YouTube, Spotify, SoundCloud, Apple Music, Internet Archive, or other providers remains subject to the applicable provider’s terms and rights.
Availability of externally hosted media is not guaranteed.
9. Products and Services
Creators or PairOfDice may offer products or services through the platform.
Listings must accurately represent the product or service being offered.
Additional terms may apply to individual transactions, digital products, services, advertising packages, creator services, merchandise, or other purchases.
10. Payments and Fees
PairOfDice may charge fees for products, services, memberships, premium features, advertising, promotion, commissions, transactions, or other offerings.
Applicable pricing and fees will generally be disclosed before purchase or participation.
Payments may be processed by third-party providers.
PairOfDice may modify pricing or fee structures prospectively as the platform develops.
11. Creator Monetization and Payouts
Eligible creators may be permitted to monetize content, products, services, profiles, events, or other activities.
Participation in monetization programs may require additional agreements, identity verification, payment-provider approval, tax information, or eligibility requirements.
PairOfDice does not guarantee any creator a particular amount of revenue, traffic, sales, engagement, sponsorship opportunities, or commercial success.
Transactions may be subject to platform fees, payment-processing fees, refunds, chargebacks, taxes, or other deductions disclosed through the applicable service.
12. Events
PairOfDice may promote, list, sponsor, organize, or provide technology relating to virtual or physical events.
Event-specific rules, eligibility requirements, waivers, ticket terms, refund policies, or participation agreements may apply.
Unless PairOfDice expressly states otherwise, listings submitted by third-party creators or organizers do not mean PairOfDice operates, endorses, or assumes responsibility for the event.
13. Advertising, Promotions, and Affiliate Links
PairOfDice may contain advertising, sponsored content, paid placements, affiliate links, and promotional material.
PairOfDice may receive compensation when users interact with or purchase through certain commercial links.
Paid or sponsored relationships may be identified where required by applicable law.
14. Creator Analytics
PairOfDice may provide creators with analytics such as page views, visits, engagement, media plays, clicks, and other performance measurements.
Analytics are provided for informational purposes and may contain inaccuracies caused by technical limitations, filtering, privacy systems, bots, browsers, third-party providers, or measurement methodologies.
PairOfDice does not guarantee that analytics will be complete or error-free.
15. Platform Availability
We work to maintain reliable Services but do not guarantee uninterrupted availability.
Features may be modified, suspended, discontinued, replaced, or updated as PairOfDice evolves.
Third-party integrations may stop working because of changes made by external providers.
16. Enforcement and Account Termination
PairOfDice may investigate suspected violations of these Terms.
We may remove content, restrict functionality, suspend accounts, terminate accounts, or take other reasonable action when necessary to protect PairOfDice, our users, third parties, or the integrity of the Services.
Users may stop using PairOfDice at any time.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
PairOfDice makes no guarantee that the Services will always be uninterrupted, error-free, secure, or suitable for a particular commercial purpose.
18. Limitation of Liability
To the maximum extent permitted by applicable law, PairOfDice Media and its owners, operators, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services.
Nothing in these Terms excludes liability that cannot legally be excluded.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold PairOfDice harmless from claims, damages, liabilities, losses, and reasonable expenses arising from your User Content, your products or services, your violation of these Terms, your infringement of another person’s rights, or your unlawful use of the Services.
20. Changes to These Terms
We may update these Terms as PairOfDice develops new functionality, business models, or legal requirements.
Material changes may be communicated through the website or other reasonable means.
Continued use of the Services after updated Terms become effective constitutes acceptance to the extent permitted by law.
21. Governing Law
These Terms will be governed by applicable United States law and the laws of the state in which PairOfDice Media is legally established, without regard to conflict-of-law principles, except where applicable law requires otherwise.
